Motions filed in Plunkett's murder case

Defense asks judge to suppress statement

Callaway County Public Defender Jason Carver Monday filed a series of motions asking the Callaway County Circuit Court to throw out statements made to investigators and several subpoenas issued by the Callaway County prosecuting attorney in the first-degree murder case against Sandra Plunkett of Holts Summit.

Plunkett, 38, is accused of fatally shooting her husband, retired 52-year-old Jefferson City police officer Paul Plunkett.

Investigators report Plunkett originally told police she was outside her home when she saw a man in camouflage with a gun walking down the street. She reportedly told investigators that when she entered the home she found her husband on the floor, shot in the back of the head.

A probable cause for arrest statement from investigators states Plunkett was arrested after she later changed her story and confessed on Jan. 4, 2011, to the Jan. 1, 2011, killing of her husband.

The confession came while being interrogated by police regarding her story of the circumstances surrounding her husband's death.

One of Carver's motions filed Monday asks that all statements made by Plunkett be suppressed, charging she was not adequately advised of her right to remain silent and that her statements could be used against her, that she had a right to have an attorney present while undergoing questioning, and that if she did not have an attorney, one would be appointed to represent her at no charge.
