No jail time in assault case

An Auxvasse woman who admitted to taking another woman to a remote part of Callaway County and assaulting her will serve no jail time.

On Friday, Brianna Kay Cavins, 23, appeared in the Callaway County Court before Judge Kevin Crane to plead guilty to assault in the third degree. She was sentenced to five years of suspended probation.

Cavins was initially arrested Feb. 15, 2017, after Callaway County Sheriff's Office deputies and investigators responded to County Road 4038 just outside of Jefferson City in southern Callaway County for a reported assault victim. Arriving deputies found a 22-year-old female victim from the Jefferson City area. The victim had sustained moderate injuries and was taken by Callaway County EMS to a Jefferson City hospital to be treated.

According to the CCSO, deputies determined the victim had been brought to the location by two other women, later identified as Cavins (then 20) and Mikayla Collins, of Jefferson City. The victim reported Cavins and Collins held her against her will, assaulted her extensively and then left her along the county roadway. The victim said that as they left, Cavins and Collins stole items belonging to her, according to the arrest report.

Within a week, Cavins and Collins had been arrested. Cavins was charged with second-degree assault, armed criminal action, second-degree kidnapping, third-degree assault and second-degree tampering with property of another. She ultimately pleaded guilty only to the third-degree assault charge.

In court Friday, Cavins admitted to acting alongside Collins to assault the victim. Cavins acknowledged she and the co-defendant picked up the victim from work in Jefferson City and took her to a remote area in Callaway County before assaulting her. Cavins admitted striking the victim in the head with a rock, according to a court press release.

As a condition of her probation, Cavins must pay more than $6,000 in restitution for the victim's medical bills.

Her co-defendant Collins was initially charged with second-degree assault, second-degree kidnapping, third-degree assault and second-degree tampering with property of another; in October 2017, she pleaded guilty to second-degree assault and was sentenced to five years of probation. In October, a failure-to-appear warrant was issued against Collins after she didn't appear in court for a scheduled restitution hearing.
