30 charges filed against Rudd

Rusty Rudd was accused in late March of 12 felony and misdemeanor counts, including rape, kidnapping and domestic assault. An amended complaint including 30 charges was filed Tuesday by Callaway County Prosecuting Attorney Christopher D. Wilson.
Rudd, 26, of Callaway County, remains in the Callaway County Jail with no bond, a jail official said Wednesday afternoon.
He was charged in a March 23 disturbance near Portland, where a victim accused Rudd of repeatedly holding her against her will, raping, choking and otherwise assaulting her, according to the original probable cause statement. Upon arriving at the scene, police officers identified Rudd as the suspect, but he already left the area before their arrival. Rudd was located March 31 at another Portland area residence and arrested without incident.
According to Wilson:
On April 5, the state filed a first amended complaint that alleged the original counts 1-12 and added counts 13-18. The complaint was filed based on additional information received by investigators at the Callaway County Sheriff's Office.
On Tuesday, the state filed a second amended complaint that alleged counts 1-18 and added counts 19-30. That complaint was based on two additional statements received by investigators at the Callaway County Sheriff's Office.
The 30 counts are split nearly even between felonies (14) and misdemeanors (16). Felony charges include:

  • One charge first-degree kidnapping,
  • Three charges second-degree rape,
  • Four charges of second- and third-degree domestic assault,
  • One charge first-degree sodomy, and
  • Five charges of tampering with a victim (felony).

Multiple misdemeanor charges accused Rudd of violating an order of protection. Three charges accused him of soliciting his mother in early April - while he was in jail - to contact the victim, a known violation.
Some of the new charges stem from incidents occurring on dates other than March 23, including several in June 2016.
"Although electronically filed, the state will need leave of court to formally file the additional charges. I anticipate that request will be made at his next scheduled appearance on April 21," Wilson said. "As leave of Court has not yet been granted to formally file the amended complaints with the additional charges, I cannot comment any further."
