Scott A. Armstrong's jury trial is set for April 8 in Callaway

Fulton man charged with assault after alleged incident with minor last spring will have pre-trial conference April 6

The pretrial conference for Scott A. Armstrong, a Fulton man charged with third-degree assault after an incident with a minor last spring, is set for April 6.

Last March, a teenage boy alleged that Armstrong, 37, put him in a choke hold, cutting off his air which caused him to lose consciousness temporarily. The boy and his parents reported the incident to the Callaway County Sheriff's Office.

Armstrong, a federal law enforcement officer at the time, pleaded not guilty in June. His trial was set for January, but was postponed after Armstrong's attorney filed a motion for a continuance at the January pretrial conference.

Callaway County Prosecuting Attorney Chris Wilson told the Fulton Sun at the time that Armstrong's attorney, Douglas C. Shull, filed the motion because one of his family members had serious medical problems. Shull filed the motion to have more appropriate time to prepare for the trial.

Judge Gary M. Oxenhandler granted the attorney's request and the trial was postponed both to give the defense extra time and because the judge had a conflict with the trial date.

Armstrong's jury trial is now scheduled for April 8 at the Callaway County Courthouse in Fulton. That date could change, depending on what happens during the pretrial conference on April 6.
